PicTrade Terms of Use
These Terms of Use govern your use of PicTrade.
PicTrade is currently provided by Anthony Russo. If PicTrade is transferred to or published by a legally formed business entity before launch, these Terms will be updated to identify the correct legal publisher.
By creating an account or using PicTrade, you agree to these Terms.
1. PicTrade
PicTrade helps people in the same event or group identify photos and videos that other participants have and transfer approved media directly between their devices.
PicTrade uses server-side services for accounts, trade coordination, protected media fingerprints, purchases, and related functionality.
Original photos and videos exchanged through a trade are transferred directly between participant devices rather than being stored by PicTrade's backend.
2. Eligibility
You must be at least 13 years old, or the minimum age required to use the service in your country or region if higher.
If applicable law requires a parent or guardian's permission for you to use PicTrade, you must have that permission.
3. Your account
You must sign in using a supported account provider such as Apple or Google.
You are responsible for:
- maintaining control of the Apple or Google account you use with PicTrade;
- activity performed through your PicTrade account;
- providing accurate information when using the service.
You may not:
- impersonate another person;
- attempt to access another person's account;
- bypass PicTrade's authentication, payment, or security systems;
- interfere with the service or other users.
4. Your photos and videos
You keep ownership of the photos, videos, and other content you own.
By choosing to share media through a PicTrade trade, you authorize PicTrade to perform the technical processing necessary to identify, coordinate, and transfer that content to the participants you choose to trade with.
You are responsible for making sure you have the right to share content you provide through PicTrade.
Do not use PicTrade to distribute content that is illegal, infringing, abusive, exploitative, or that you do not have permission to share.
5. Direct device-to-device transfers
PicTrade is designed so original traded photos and videos transfer directly between participant devices.
Transfer success can depend on factors outside PicTrade's control, including:
- device availability;
- local network conditions;
- Apple platform behavior;
- permissions;
- storage space;
- whether another participant remains available long enough to finish the transfer.
PicTrade does not guarantee that every transfer will complete successfully.
6. Trades
A host may create a trade and invite other participants.
Trade information may include:
- event or trade name;
- date;
- description;
- venue;
- trade cover;
- participants.
Trade availability may be temporary.
Participants are responsible for confirming that they are joining the intended trade before sharing or receiving media.
7. Purchases
PicTrade may offer:
- individual trade unlocks;
- group trade unlocks;
- subscriptions;
- promotional or complimentary entitlements.
Prices shown in the app are provided through Apple's App Store and may vary by country, currency, taxes, or Apple's pricing rules.
Purchases are processed by Apple.
PicTrade does not directly process your credit card information.
8. Subscriptions
PicTrade may offer automatically renewing subscriptions, including PicTrade Pro.
If you purchase a subscription:
- payment is charged through your Apple Account;
- the subscription may automatically renew unless canceled;
- renewal and cancellation are managed through your Apple Account/App Store settings;
- features remain subject to the plan shown at the time of purchase and applicable App Store terms.
Deleting your PicTrade account does not automatically cancel an active App Store subscription.
9. Refunds and billing
Apple controls App Store billing and refund decisions.
If Apple refunds, revokes, or otherwise invalidates a transaction, PicTrade may remove or adjust the related entitlement.
PicTrade may retain transaction identifiers necessary to:
- verify purchases;
- restore purchases;
- honor refunds;
- prevent a transaction from being reused improperly.
10. Free and promotional access
PicTrade may provide free, promotional, development, complimentary, or account-specific access.
Such access may:
- have additional limits;
- expire;
- be unavailable to other users;
- be discontinued when permitted by law.
Promotional access does not create a right to receive the same benefit permanently.
11. Account deletion
You may request account deletion inside PicTrade.
Deleting your PicTrade account may remove or invalidate:
- your PicTrade account;
- active sessions;
- provider sign-in links;
- account-specific unlocks;
- locally stored profile and Past Trades information on that device.
Photos and videos already saved to your photo library are not automatically deleted.
Some transaction records may remain where necessary for purchase verification, refunds, restores, revocations, fraud prevention, or similar legitimate purposes.
12. Acceptable use
You may not use PicTrade to:
- break the law;
- distribute content you do not have the right to share;
- harass, exploit, threaten, or harm another person;
- attempt to access another user's account or device;
- reverse engineer or attack PicTrade except where applicable law expressly allows it;
- exploit bugs or vulnerabilities;
- bypass purchases or entitlement checks;
- interfere with PicTrade's servers, peer-to-peer transfers, or security;
- automate abusive requests;
- distribute malware or malicious code.
PicTrade may restrict or terminate access when reasonably necessary to protect users, the service, or comply with law.
13. Service availability
PicTrade may change, improve, temporarily suspend, or discontinue parts of the service.
We do not guarantee that PicTrade will always be:
- uninterrupted;
- error-free;
- available on every device or network;
- compatible with every future version of iOS.
We may perform maintenance or make changes necessary for security, reliability, compliance, or product development.
14. Third-party services
PicTrade relies on third-party services including Apple, Google, Render, and MongoDB Atlas.
Those services operate under their own terms and policies.
PicTrade is not responsible for outages, restrictions, or actions caused by third-party services outside its reasonable control.
15. Privacy
Your use of PicTrade is also governed by the PicTrade Privacy Policy.
The Privacy Policy explains what information PicTrade collects, why it is collected, how it is handled, and your choices.
16. Intellectual property
PicTrade, including its software, branding, interface, designs, and other original materials, is protected by applicable intellectual-property laws.
These Terms do not give you ownership of PicTrade or permission to copy, sell, redistribute, or commercially exploit PicTrade's software or branding except where expressly authorized.
17. Disclaimers
PicTrade is provided on an "as is" and "as available" basis to the extent permitted by law.
We cannot guarantee that:
- every media match will be perfect;
- every transfer will complete;
- every device or network will behave the same way;
- the service will always be available.
Nothing in these Terms excludes rights that cannot legally be excluded.
18. Limitation of liability
To the maximum extent permitted by applicable law, PicTrade and its publisher will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use PicTrade.
Nothing in these Terms limits or excludes any liability that cannot lawfully be limited or excluded under applicable law.
19. Governing law
These Terms are governed by the laws of the State of Florida, United States, except where applicable consumer law requires otherwise.
Any mandatory rights you have under the laws where you live remain unaffected.
20. Changes to these Terms
These Terms may be updated as PicTrade changes.
If a material change is made, the effective date at the top of this page will be updated.
Continued use of PicTrade after revised Terms become effective means you accept the updated Terms where permitted by law.
